Client Projects & Content Ownership

For projects commissioned by clients:

· Raw Footage & Assets: All raw footage, audio recordings, digital files, and project assets captured and/or created by Smash Flick LLC remain the sole property of Smash Flick LLC until full and final payment for services is received.

· Final Deliverables: Upon final payment, the client is granted a perpetual, non-exclusive license to use the final edited video deliverables for their intended purposes (e.g., personal use, business marketing, online distribution). Smash Flick LLC retains the right to use any and all footage and final projects for its own promotional purposes (e.g., portfolio, demo reel, marketing materials) unless a separate Media Buyout is negotiated and contracted prior to the project commencement.

Accuracy and Ethical Journalism

Smash Flick LLC is committed to the principles of ethical journalism and documentary filmmaking. We strive for accuracy, fairness, and transparency in all our narrative and journalistic work. However, we cannot guarantee that all information is entirely free of error. The views and opinions expressed in interviews or narrative content are those of the individuals and do not necessarily reflect the official policy or position of Smash Flick LLC. We correct any significant errors of fact promptly and transparently.

Limitation of Liability

To the fullest extent permitted by law, Smash Flick LLC, its members, employees, and contractors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from:

· Your access to, use of, or inability to use the website or our services.

· The performance of our services, including any delays, cancellations, or unforeseen circumstances beyond our reasonable control (e.g., weather, equipment failure, acts of God, client-provided material issues).

Client Responsibilities & “Be The Star” Projects

Clients participating in "Be The Star" or any other production agree to:

· Obtain all necessary permissions for filming at chosen locations.

· Secure signed model release forms from all non-Smash Flick participants appearing on camera, granting Smash Flick LLC and the client permission to use their likeness.

· Ensure the content of their project does not infringe upon the copyrights, trademarks, or other rights of any third party. Smash Flick LLC assumes no liability for content provided or directed by the client.

Bespoke Collaborative Pricing (B.C.P.)

Our B.C.P. model is designed for flexibility. All pricing is subject to change based on project scope, client-provided resources, and collaborative adjustments. All services and final pricing must be outlined and agreed upon in a formal written contract prior to the commencement of any project. Verbal estimates are not binding.

Donations & Sponsored Projects

Donations made to Smash Flick LLC are voluntary contributions to support our mission of amplifying underrepresented voices. While we endeavor to use all donations for their stated purpose, they are not refundable. Recognition in project credits for monthly subscribers is offered as a courtesy and is subject to project feasibility and editorial discretion.
